Transitioning Between Florida District Home Education and PEP

You can move from district Home Education to PEP, or back again. It is not automatic. The parent files the district notice. The SFO does not do that for you.

If you are moving from district Home Education to PEP, confirm the required notice and timing with your district and SFO. This hub does not process disenrollments or legal notices.

Two mutually exclusive legal classifications

In Florida, District Home Education and the Personalized Education Program (PEP) are two distinct legal pathways. Both can mean parent-directed learning outside a conventional classroom. You cannot legally participate in both at the same time.

The statutes

  • District Home Education (s. 1002.41, F.S.): Sequentially progressive instruction directed by the parent. Registered with the county superintendent through a Notice of Intent. Parent-funded. Oversight is mainly the annual evaluation.
  • PEP (s. 1002.395(7), F.S.): An Education Savings Account scholarship under the Florida Tax Credit Scholarship framework. Administered by Scholarship Funding Organizations — Step Up For Students and AAA Scholarship Foundation — under FLDOE oversight.

Under s. 1002.41(1)(c), F.S., a parent must file a written Notice of Termination when the student enrolls in a Chapter 1002 scholarship program. PEP participants are scholarship students. District Home Education must be closed before scholarship funding can proceed as the SFO currently requires.

Why the programs cannot overlap

  1. Funding: State scholarship dollars are not allocated to a student who remains independently registered as district Home Education.
  2. Accountability: District Home Education uses one of five evaluation options. PEP requires an annual norm-referenced test and a Student Learning Plan. Dual enrollment would collide those rules.
  3. Account holds: If a child stays on the district Home Education roster while an SFO tries to release funds, compliance checks can freeze the account.

Compulsory attendance (s. 1003.21, F.S.)

Florida requires regular attendance (generally ages 6 by February 1 of the school year through 16) or an authorized alternative, including a home education program under s. 1002.41, F.S. PEP satisfies attendance as a Chapter 1002 scholarship path. Time the transition so there is no gap that could trigger a truancy inquiry. Confirm current attendance questions with your district.

Path 1 — District Home Education → PEP

Do the phases in order. The most common error is closing district Home Education too early.

Phase 1 — Apply while you stay registered

Submit the PEP application in your SFO portal (Step Up EMA or AAA SMP) while the student remains fully registered under District Home Education.

Do not file a district Notice of Termination while the application is only submitted, under review, or waitlisted. Keep the activity log and portfolio current.

If you terminate before a funded award, and the application is delayed or denied, the child may have no recognized schooling status under s. 1003.21, F.S.

Phase 2 — Wait for a funded award

Wait for formal notice from the SFO that the student has been awarded a funded PEP seat.

  • Log in to EMA or SMP.
  • Confirm the status shows awarded and funded for that school year.
  • Keep the SFO scholarship ID with your records.

Do not treat “submitted” as “awarded.”

Phase 3 — File a written Notice of Termination

Once the funded award is confirmed, close the s. 1002.41 program with the county superintendent.

30-day window (s. 1002.41(1)(c), F.S.). The parent shall file a written notice of termination upon completion of the home education program, or upon enrollment in a public or private school or a scholarship program under Chapter 1002, within 30 days after that termination.

What to include (minimum):

  1. Student’s full legal name
  2. Date of birth
  3. Residential address
  4. Effective date of termination
  5. Reason: transitioning to PEP under s. 1002.395, F.S.
  6. Parent or legal guardian signature and date

Proof of delivery (practical, keep forever):

  • Mail: USPS Certified Mail with return receipt
  • Email or district portal: save the sent message with timestamps and ask the Home Education office for a written acknowledgment

Confirm your district’s current intake method with the county office. This hub does not file the letter for you.

Phase 4 — Show the SFO that district Home Education is closed

Both SFOs need district disenrollment before full spend rails unlock. Their proof steps differ. Do not collapse them into one rigid hub rule. Confirm the current upload or acknowledgment steps inside your portal.

  • AAA Scholarship Foundation: Upload proof of district disenrollment (for example the district acknowledgment or certified-mail receipt) to SMP before the Student Learning Plan will be reviewed or funds released — that is AAA’s stated sequence.
  • Step Up For Students: The PEP Family Handbook says district termination must occur upon participation in PEP. Parents complete verification acknowledgments in EMA that the student is no longer registered under s. 1002.41, F.S.

Safeguard: Get the funded award first. File the district termination promptly. Keep delivery proof. Upload or acknowledge in the SFO portal as that SFO currently instructs.

Phase 5 — SLP and spend activation

After disenrollment is finalized and verified:

  1. Submit the annual Student Learning Plan in the SFO portal.
  2. After the SFO accepts the SLP, use the current spend rails (for example MyScholarShop in EMA, or reimbursement in EMA / AAA SMP) according to the Purchasing Guide. Confirm current purchase rules in the live portal. This hub does not approve, verify, or predict payment.
  3. Plan the required annual norm-referenced test and the SFO’s submission window.

Path 2 — PEP → District Home Education

Families leave PEP for many reasons: less standardized testing, less portal work, or full control of purchases outside SFO rules. Sequence still matters.

Phase 1 — Time the exit and tell the SFO

Mid-year moves are possible. Ending at a semester or school-year break is often simpler for records.

Submit a disenrollment or exit request in the SFO portal (EMA support ticket or AAA SMP disenrollment form). Give the date PEP participation ends.

Submit pending reimbursement claims for eligible purchases made while still enrolled before you close the SFO account.

Phase 2 — File a Notice of Intent

Under s. 1002.41(1)(a), F.S., re-establish Home Education with a written Notice of Intent to the county superintendent within 30 days of beginning the program.

What to include (minimum): student name, date of birth, address, parent signature and date.

The district registers the program. It does not have statutory authority to approve curriculum, require standardized testing, or inspect your home as a condition of registration. Ask for written confirmation of the registration date.

Phase 3 — Unspent scholarship funds

Scholarship dollars in a PEP account belong to the state program, not the parent. Unspent funds cannot be withdrawn as cash, moved to a personal bank account, or rolled into district Home Education.

When a student leaves PEP, unspent funds stay in the SFO account under statutory and SFO expiration rules (they typically revert after inactivity or formal exit). Confirm exact closure rules in your SFO handbook. This hub does not quote balances or deadlines.

Phase 4 — Portfolio and annual evaluation

  • Keep a dated activity log made at the same time as instruction, plus work samples (s. 1002.41(1)(b), F.S.).
  • Keep the portfolio at least two years. The superintendent may inspect it only after 15-day written notice.
  • You are no longer on PEP’s required norm-referenced test. For the annual evaluation on the Notice of Intent anniversary, choose one of the five statutory options under s. 1002.41(1)(f), F.S. (a portfolio review with a Florida-certified teacher is the option many families use).

Visual workflows

Workflow A — Home Education → PEP

  1. Apply to the SFO. Apply via Step Up (EMA) or AAA (SMP). Keep s. 1002.41 District Home Education active. Keep the portfolio current.
  2. Receive a funded award. Wait for awarded + funded status in the SFO portal. Do not terminate district status before this.
  3. File district termination. Written Notice of Termination to the county superintendent within 30 days (s. 1002.41(1)(c)). Keep certified-mail or email acknowledgment.
  4. Provide proof to the SFO. AAA: upload disenrollment proof to SMP before SLP review. Step Up: confirm termination in EMA as instructed.
  5. Activate PEP rails. Submit the SLP. After SLP acceptance, use MyScholarShop or reimbursement per current portal rules. Schedule the annual norm-referenced test.

Workflow B — PEP → Home Education

  1. Plan exit and notify the SFO. Pick a date. Submit the exit request. Finish pending eligible reimbursements.
  2. Close spend rails. Unspent funds revert per statute / SFO rules. They cannot be cashed out or moved to Home Education.
  3. File Notice of Intent. Written Notice of Intent to the county superintendent within 30 days of starting s. 1002.41. Get written confirmation.
  4. District compliance. Parent-funded, parent-directed curriculum. Concurrent portfolio (log + samples), keep 2 years. Choose 1 of 5 statutory annual evaluations.

Comparison (what changes when you move)

What changes when a student moves between district Home Education and PEP.

Funding Parent-funded ESA Entering PEP opens SFO rails; leaving PEP forfeits unspent program funds
Entry Notice of Intent SFO application File entry papers with the incoming office
Exit Notice of Termination (30 days) SFO disenrollment Home Ed → PEP needs district termination; PEP → Home Ed needs SFO exit
Proof District acknowledgment SFO may require district proof AAA: proof before SLP review; Step Up: EMA acknowledgment — confirm live
Annual check 1 of 5 options Required norm-referenced test PEP adds required testing; leaving PEP removes that PEP rule
Learning plan 2-year portfolio Annual SLP PEP requires an SLP
Purchasing Parent autonomy SFO Purchasing Guide PEP spend follows portal rules; Home Education restores parent-funded choice

Common pitfalls

Pitfall 1 — Closing the district too early

Risk: You apply in spring, terminate immediately, then learn in late summer that PEP is waitlisted or needs more documents. The student has no recognized status under s. 1003.21, F.S.

Mitigation: Do not terminate based on an application alone. Wait for funded award confirmation in the SFO portal.

Pitfall 2 — Skipping the Notice of Termination

Risk: You receive an award and start shopping in the portal, assuming the SFO told the district. Later a compliance check finds the child still on s. 1002.41 and freezes the account.

Mitigation: File the written Notice of Termination as soon as the award is confirmed. Keep proof.

Pitfall 3 — Assuming the SFO notifies the district

Reality: The parent — not the SFO — files and terminates a s. 1002.41 program. Keep your own district correspondence.

Pitfall 4 — Mixing up the spend category and district status

SFO guides may list home education instructional program as a purchase category. That is not district Home Education under s. 1002.41, F.S. Buying those materials does not keep (or require) district registration and does not allow dual enrollment.

Pitfall 5 — Throwing out the old portfolio

s. 1002.41(1)(b), F.S., says keep portfolios at least two years from the instruction dates. A superintendent may still request inspection, with 15-day notice, for the period the student was in district Home Education. Archive the old portfolio after you leave.

Pitfall 6 — Discovering required testing late

PEP requires an annual norm-referenced assessment. If you are used to a portfolio conversation only, read the current SFO handbook’s assessment list and submission steps early in the year.

FAQ

Can we apply for PEP and stay listed with the district?

No. You may apply while still registered. You may not receive and use PEP as a dual enrollment. After a funded award, file the district Notice of Termination. Confirm the required notice and timing with your district and SFO.

Will Step Up or AAA tell my school district?

No. Filing and terminating district Home Education is the parent’s responsibility.

Does AAA need different proof than Step Up?

Official materials describe the steps differently. AAA states that district disenrollment proof must be uploaded before the SLP is reviewed. Step Up emphasizes termination upon PEP participation and EMA acknowledgments. Confirm the live sequence in your portal. This hub does not pick a single merged rule.

What happens to money left in the PEP account if we return to Home Education?

Unspent scholarship funds belong to the program. They do not cash out and do not transfer into district Home Education. Confirm closure and expiration rules in your SFO handbook.

Is “home education instructional program” the same as staying with the district?

No. It is a scholarship spend-category phrase. It is not s. 1002.41 registration.

How much is the award? Are applications open?

We do not list award amounts. Official sources describe future PEP capacity differently. Confirm award details, capacity, and live application status with FLDOE and your SFO portal.
