Driving privilege and school-attendance compliance for Florida home-education minors

Under section 322.091(1), F.S., a minor is not eligible for driving privileges unless that minor is enrolled in a public school, nonpublic school, or home education program and satisfies relevant attendance requirements. A home education program that meets the requirements of chapter 1002 is a method of regular school attendance. This page is about that rule, what Forms HSMV 72870 and 72871 are for, and what the first-time process is not. It is not legal advice.

Confirm the first-time process, and whether any district document is needed, with the Florida Department of Highway Safety and Motor Vehicles (FLHSMV) and your district home education office. Tools for Education does not issue licenses or verify attendance.

An infographic titled "Teen Driving and Home Education in Florida", subtitled "What s. 322.091, F.S. says". A quote box reads: "A minor is not eligible for driving privileges unless that minor ... is enrolled in a public school, nonpublic school, or home education program and satisfies relevant attendance requirements." s. 322.091(1)(a), F.S. Two boxes follow. "Home education counts": a home education program that meets the requirements of chapter 1002 is a method of regular school attendance (s. 1003.01(16)(d)). "Both parts matter": the rule has two parts, enrollment and relevant attendance requirements. A wide box, "What the statute does not say", says it names no first-time form and to confirm the first-time process, and whether any district document is needed, with FLHSMV and the district home education office. A footer says to confirm current rules with FLHSMV, your district home education office and the Florida Statutes, that Tools for Education is an independent information hub and not FLHSMV or your school district, and that this is not legal advice.
Under Florida Statutes section 322.091(1)(a), a minor is not eligible for driving privileges unless enrolled in a public school, nonpublic school, or home education program and satisfies relevant attendance requirements. The statute names no first-time form; confirm the first-time process with FLHSMV and your district home education office.
A pointer map titled "First-Time License vs. Reinstatement". Two boxes sit side by side. "First-time learner's license": s. 322.091 names no first-time form; confirm the process with FLHSMV and the district office. "After an attendance noncompliance notice (reinstatement)": Forms HSMV 72871 and HSMV 72870 are reinstatement forms used only after notice. Below, "Statute vs. FLHSMV Wording": the statute says 30 days of compliance; the FLHSMV page and Form 72871 say 30 consecutive days. A banner says this is a pointer map, not advice; to confirm with FLHSMV, your district home education office and the Florida Statutes; and that Tools for Education is an independent information hub, not FLHSMV or your school district.
Forms HSMV 72870 and 72871 are reinstatement forms, used only after an attendance noncompliance notice. They are not first-time permit forms. For a first-time license, confirm the process with FLHSMV and your district home education office.

What the statute says

Section 322.091(1), F.S., states: “A minor is not eligible for driving privileges unless that minor:” and then, in (1)(a), “Is enrolled in a public school, nonpublic school, or home education program and satisfies relevant attendance requirements.”

Both parts matter. Enrollment is not the whole rule. The same sentence also requires that the minor satisfy relevant attendance requirements.

A home education program that meets the requirements of chapter 1002 is a statutory method of regular school attendance (s. 1003.01(16)(d), F.S.). A home education program is not a school district program. It is registered with the district school superintendent only for the purpose of complying with the state’s attendance requirements under s. 1003.21(1), F.S. (s. 1002.41(1), F.S.).

The department may not issue a driver license or learner’s driver license to, or shall suspend the driver license or learner’s driver license of, any minor concerning whom the department receives notification of noncompliance with the requirements of this section (s. 322.091(1), F.S., closing sentence).

Tools for Education is an independent information hub. We are not FLHSMV, not the Florida Department of Education (FLDOE), and not a school district. We do not issue licenses or verify attendance. This page is not legal advice. Confirm current rules with FLHSMV, your district home education office, or the statute.

First-time license

Section 322.091 names eligibility conditions. It does not name a first-time learner’s-license form or a district letter.

Confirm the first-time process, and whether any district document is needed, with FLHSMV and the district home education office. This page does not invent a form number for that step.

Whether any district “enrollment verification letter,” “registration acknowledgment,” or other first-time packet is required is unverified. This page does not tell parents to get or bring such a letter.

Reinstatement after a notice

Forms HSMV 72870 and HSMV 72871 are reinstatement and withhold forms. They are used after a minor has been reported noncompliant with school attendance and FLHSMV has issued a Notice of Intent to Suspend or Withhold Eligibility for Licensure. They are not first-time permit forms.

The printed title block on Form HSMV 72871 is “Student Compliance with Enrollment Requirements for A Home Education Program.” The printed title block on Form HSMV 72870 is “Student Compliance with Attendance Requirements For Reinstatement of Driving Privilege/Eligibility for Licensure.”

Under s. 322.091(4), F.S., a district school board shall provide a minor with written verification that he or she is in compliance with subsection (1) if the district determines that he or she has been in compliance for 30 days prior to the request. Upon receiving that written verification, the department shall reinstate the minor’s driving privilege.

The wording “30 consecutive days” appears on the FLHSMV teen-drivers page and on Form HSMV 72871. The statute text says “30 days.”

What the statute does not say

Section 322.091, F.S., does not set these items:

  • A numbered first-time learner’s-license form.
  • A fee. The section contains no dollar figures.
  • A daily-hour rule for driver licensing. Hour or attendance-sheet inferences for licensing stay unverified here. The portfolio log under s. 1002.41(1)(d), F.S., is a different Chapter 1002 duty; see the portfolio guide.

FAQ

Does Florida law require a home-education attendance form for a first-time learner’s license?

Section 322.091 names no first-time form. Confirm the first-time process, and whether any district document is needed, with FLHSMV and your district home education office.

Should I bring Form HSMV 72871 to a first-time permit appointment?

No. Forms HSMV 72870 and 72871 are reinstatement and withhold forms used after an attendance noncompliance notice. They are not first-time permit forms.

Does enrollment in a home education program by itself satisfy the driving rule?

The statute has two parts: enrollment in a public school, nonpublic school, or home education program, and satisfying relevant attendance requirements (s. 322.091(1)(a), F.S.). A home education program that meets chapter 1002 is a method of regular school attendance (s. 1003.01(16)(d), F.S.). This page does not treat registration alone as enough.

What is the 30-day rule?

It is a reinstatement rule. After a noncompliance notice, s. 322.091(4), F.S., says the district provides written verification if the minor has been in compliance for 30 days prior to the request. The FLHSMV teen-drivers page and Form HSMV 72871 use the wording “30 consecutive days.”

Does this page list license fees?

No. Section 322.091 contains no dollar figures. Confirm current fees with FLHSMV.

Is this the Notice of Intent page?

No. Filing the program with the district lives on the Notice of Intent guide.

Confirm current details with these sources, and with FLHSMV or your district home education office, before you rely on them. FLDOE web pages were not fetchable when this research was written (HTTP 403) and stay unverified as live web text.
